The deadline for the оформление of unclaimed shares in Ukraine has been extended until 2028
The Ukrainian parliament has adopted a law that extends the deadline for the оформлення of unclaimed land shares until 2028. This is important news for owners and heirs who, due to the war, were unable to complete this procedure in Time.
This decision gives more time for owners and heirs to restore their land rights, especially in the context of a military conflict. The law also includes changes aimed at protecting the rights of landowners.
Who influenced this decision?
The Law of Ukraine 'On Amendments to Certain Legislative Acts of Ukraine Regarding the Protection of the Interests of Owners of Land Shares (Shares)' provides for an extension of the deadline until January 1, 2028. In Ukraine, there are about 104.4 thousand unclaimed shares.
If the owner of a share or its heir cannot оформити ownership rights by the specified deadline, the land will transfer to the communal property of the territorial community. However, for seven years, the transfer of such plots into private ownership is prohibited, except in cases of returning rights to the owners of shares or their heirs.
Other changes introduced by this law:
- the pilot project for entering data into the State Land Cadastre by certified land survey engineers has been extended until 2026;
- mandatory qualification upgrading for land survey engineers, geodesists, and land appraisers has been restored from February 7, 2025;
- lands under water bodies of national significance have been established as state property;
- the use of funds received from losses in agricultural production has been clarified.
